1. Agreement and Company Identity
These Terms govern your use of KAZDOC USA websites, forms, payment links, communications, appointments and services. KAZDOC USA is a trade name operated by OrazAva LLC d/b/a KAZDOC USA (“Company,” “we,” “us” or “our”). By submitting a request, ordering or paying for a service, you accept these Terms and our Privacy Policy.
2. Private Company; No Government Affiliation
We are a private company. We are not a government agency and are not affiliated with or endorsed by any embassy, consulate, court, Secretary of State, USCIS, the U.S. Department of State or other public authority. Government decisions, processing times, fees and acceptance remain outside our control.
3. No Legal Advice or Attorney-Client Relationship
OrazAva LLC is not a law firm. Unless a separate written agreement expressly identifies a licensed attorney, our services are administrative, clerical, translation, notarial, courier, filing-support or document-preparation services. We do not provide legal advice or court representation. Use of our services does not create an attorney-client relationship.
4. Customer Instructions and Accuracy
You must provide complete, accurate and lawful information, review all drafts before signing or filing, and confirm the receiving authority’s current requirements. We may rely on the information and instructions you provide. We may refuse work that appears unlawful, misleading, incomplete or outside our permitted scope.
5. Translators, Contractors and Service Providers
We may use qualified employees and independent contractors, including translators, reviewers, notaries, couriers, technology providers, payment processors and filing agents, when reasonably necessary to perform the requested service. This does not imply that every translator or every translation is individually certified by the American Translators Association.
6. Documents, Originals and Retention
You remain responsible for keeping copies of all materials. Original documents may be transferred to couriers, government offices or other recipients required for the service. We use reasonable care but cannot guarantee third-party shipping or government handling. We may retain inquiries, order records, working files and document copies for the period reasonably necessary to perform the service, maintain records, prevent fraud, resolve disputes and meet legal obligations, after which they may be securely deleted according to our practices.
7. Fees, Payments, Refunds and Chargebacks
Prices, government fees, shipping and third-party charges are disclosed in the applicable quote, order page or invoice. The separate Refund Policy remains controlling where applicable. Before filing a chargeback, you agree to contact us at info@kazdocusa.com and allow a reasonable opportunity to review the transaction. Fraudulent or knowingly false chargebacks may be disputed using order records, communications, delivery evidence and service documentation. Nothing in this section limits non-waivable consumer rights.
8. No Guarantees
Estimates are not guarantees. We do not guarantee acceptance, issuance, approval, processing time, delivery date, legal effect or outcome. Public authorities and receiving organizations control their own decisions and requirements.
9. Written Claim and Individual Court Proceeding
Before filing a lawsuit, the claimant must send a written description of the dispute and requested resolution to info@kazdocusa.com and allow 30 days for a good-faith effort to resolve it. If unresolved, either party may bring an individual claim in a court with jurisdiction. These Terms do not require arbitration.
10. Class Action Waiver
To the fullest extent permitted by applicable law, claims must be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. This waiver does not apply where prohibited by law.
